NHS Hertfordshire and West Essex Integrated Care Board (ICB) are continuing with the 3 existing contracts to provide Special Allocation Scheme Service in the following areas.Please Note: Due to the nature of the Special Allocation Scheme Service and the potential risks in relation to staff and patient safety the Commissioner cannot disclose the contract holders names and addresses.1. East and North HertfordshireAwarded for a period of 3 years with the option to extend for a further 2 years. Annual Contract Value of £32,500 (£1083 pp).Cap of 30 patients – additional payment for patients over this at a rate of 90% of pp cost.2. West EssexAwarded for a period of 3 years with the option to extend for a further 2 years. Annual Contract Value of £32,500 (£1083 pp). Cap of 30patients – additional payment for patients over this at a rate of 90% of pp cost.3. South and West EssexAwarded for a period of 3 years with the option to extend for a further 2 years. Total Quantity or Scope
GP led primary medical care services to patients registered on the Special Allocation Scheme (SAS) who have been removed from general practice due to exhibiting violent or aggressive behaviour.The service(s) shall also provide support for rehabilitation of Registered Patients in order to address the underlying causes of violent or aggressive behaviour and encourage and support facilitation of return to general practice.

Legal Justification
The current contracts for Special Allocation Scheme Service in East and North Hertfordshire, West Essex, South and West Essex are due to expire on 31 March 2024.Hertfordshire and West Essex ICB therefore published a Prior Information Notice (PIN) to the open market on 8 August 2023 and invited all interested parties to participate in an early market assessment questionnaire. The notice also stated that should only one provider register an interest and meet the requirements, the ICB reserve the right to award to that provider without further publication following due diligence checks.Following the conclusion of the market assessment questionnaire and publication of a Prior Information Notice the Commissioner only received expressions of interest from providers who are currently delivering the service.The ICB has therefore concluded that Regulation 32 of the The Public Contracts Regulations 2015 is applicable to this situation and wish to continue with the 3 contracts with the 3 existing providers.Use of the negotiated procedure without prior publication32.—(1) In the specific cases and circumstances laid down in this regulation, contracting authorities may award public contracts by a negotiated procedure without prior publication.(2) The negotiated procedure without prior publication may be used for public works contracts, public supply contracts and public service contracts in any of the following cases:—(a)where no tenders, no suitable tenders, no requests to participate or no suitable requests to participate have been submitted in response to an open procedure or a restricted procedure, provided that the initial conditions of the contract are not substantially altered and that a report is sent to the Commission where it so requests;
Other Information
The Service to which this Procurement relates fall within Schedule 3 of the Public Contracts Regulations 2015 (the" Regulations") as amended by The Public Procurement (Amendment etc)(EU Exit) Regulations 2020, (the" Regulations") and the Procurement ,Patient Choice and Competition Regulations (2) 2013.As such, the Contracting Authority does not intend to hold itself bound by any of the Regulations, or those applicable to Schedule 3 Service.
