Legal Justification
The Council believes that the decision to award a new contract to Greater Manchester Mental Health Trust for the provision of a Medically Managed Inpatient Detoxification service is permitted pursuant to Regulation 32(2)(b)(ii) include 1)Market competition in the sector for medically managed Inpatient Detoxification is absent for technical reasons: this is a highly complex integrated service with well - developed pathways for all community treatment providers in the 11 Local Authorities. There is some other provision available, but this is medically monitored (as opposed to medically managed) and not suitable for patients with complex health needs. Therefore, no reasonable alternative substitute provision exists in the market at the present time 2) the existing provision being a highly complex integrated solution across the Yorkshire and Humber region and affording the region the opportunity to continue to benefit from the high performing service under new contracts with the provider with minimal disruption to service users 3)Changes to the way NHS and some Public Health services are commissioned.
