Legal Justification
Modification to the current Framework (CAT-19-015) is necessary to ensure ongoing service provision and to facilitate the procurement of additional requirements until the commencement of a new arrangement is in place. These requirements have become necessary and are permitted by Regulation 72(1)(c) of The Public Contacts Regulations 2015. Namely, the following conditions have been fulfilled: (i)the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen; The Education Authority set up CAT-23-001 Dynamic Purchasing System for Catering Equipment which went live in May 23 with the original intention of running further competitions from the DPS. Following ongoing publications in relation to the Procurement Act 2023, the EA would like to review its long term strategy for the procurement of Catering Equipment, including review of the opportunities and flexibilities offered under the Procurement Act (2023). It is envisaged that this process may take up to six months, and therefore, the EA intend to extend it’s current arrangements for six months, with the options to extend by two further periods of three months if deemed necessary to enable a new procurement to be concluded. (ii)the modification does not alter the overall nature of the contract; The nature of the Framework Agreement is not being amended. (iii)any increase in price does not exceed 50% of the value of the original contract or framework agreement. The upper estimate of the original Framework Agreement was £1,128,600 GBP, this modification will include for the provision of an additional £564,000 which is less than 50% of the original maximum value of £1,128,600. This does not exceed 50% of the value of the Framework. The new total value of the Framework Agreement would be £1,692,600.
