Legal Justification

Following the award of the original contract (Contract Award Notice No. MAR408511) there has been an unexpected need for a greater intensity and duration of service. Given the nature of the Inquiry, a continued uninterrupted service and operation is required. The service requirement is time sensitive and must fit with the anticipated programme of the Inquiry. A change of supplier at this stage would disrupt the Inquiry, cause serious operational difficulties and result in cost increases. Reliance on Regulation 33(1)(b)(ii) is therefore satisfied in this case.
