Description
NHS Bath and North East Somerset Integrated Care Board ("BSW") is commissioning a Hospice provision for children and young people including medically supported short respite breaks, symptom management, stepped discharge from hospital, emergency and end-of-life care. BSW is directly awarding a contract to the existing provider Naomi House and Jacks Place (Wessex Children's Hospice Trust) in accordance with the criteria outlined in Regulation (9) of the Health Care Services (Provider NHS Bath and North East Somerset Integrated Care Board ("BSW") is commissioning a Hospice provision for children and young people including medically supported short respite breaks, symptom management, stepped discharge from hospital, emergency and end-of-life care. BSW is directly awarding a contract to the existing provider Naomi House and Jacks Place (Wessex Children's Hospice Trust) in accordance with the criteria outlined in Regulation (9) of the Health Care Services (Provider Selection Regime) Regulations 2023. The value of the contract is £54,385 per annum. The approximate lifetime value of the contract is £163,155. The one year contract will commence on 1st April 2024. This service will be subject to a competitive process commencing in 2024 with a service operational and in place from 01st April 2025.

Bath and North East Somerset, Swindon and Wiltshire ICB are intending to award a contract to the existing provider following direct award process C. The services within this contract have been identified and notified as on the reserve list of services to be considered to be included in the Integrated Community Based Care Contract which is currently in the Invitation To Tender (ITN1) stage of procurement. Reserve services will not be included in that contract from 1 April 2025, but will be considered to be included in the future which has informed the contract term for this procurement. … The contract is for a three years (1 April 2024 to 31 March 2027)

Legal Justification
This is a Provider Selection Regime (PSR) intention to award notice. The awarding of this contract is subject to the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award. The publication of this notice marks the start of the standstill period. Representations by providers must be made to the relevant authority by the 5th April 2024. This contract has not yet formally been awarded; this notice serves as an intention to award under the PSR.

The Commissioner made the decision of directly awarding the incumbent provider Naomi House and Jacks Place (Wessex Children's Hospice Trust) in accordance with the following five criteria outlined in Regulation (9) of the Health Care Services (Provider Selection Regime) Regulations 2023: • Quality and innovation • Value • Integration, collaboration, and service sustainability • Improving access, reducing health inequalities and facilitating choice • Social value The current incumbent, Naomi House and Jacks Place (Wessex Children's Hospice Trust, meets and in some cases exceeds the requirements. The provider is currently meeting the required outcomes within the contract. They offer good value for money and are meeting activity expectations. The decision was approved in line with Bath & North East Somerset Integrated Care Board's Scheme of Reservation and Delegation by the Finance and Investment Committee. There were no conflicts of interest identified among committee members. This is a Provider Selection Regime (PSR) intention to award notice.
