Indicators
- Contract modified due to unforeseen circumstances.
Legal Justification
The contract had a local price at circa 75% of tariff when the contract commenced. Since then, we have had a period of unprecedented inflation and no uplifts to the contract. The provider could not sustain the tariff in their bid and advised that they would need to terminate the contract if the Commissioner would not agree to the national tariff + MFF. The Commissioner agreed, under Regulation 14, to modify this contract due to these urgent circumstances to ensure continuity of this critical service to patients.
Other Information
This is a Provider Selection Regime (PSR) contract modification notice. This contract has been modified under the urgent circumstances provision of the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award. This contract has now been formally modified. The decision-makers of this modification are the ICB's Executive Management Committee. No conflicts or potential conflicts of interest of individuals making the decision have been identified.
