Legal Justification
This modification is in accordance with Regulations 72(1)(b)(i) and (ii). A tender procedure for the products covered in the aforementioned contract began in January 2023, with preliminary market engagement taking place in September 2023 via the following PIN notices: 2023/S 000-026575 & 2023/S 000-026591. It is projected that the tender will be issued to the market for bids in the summer of 2024. Extensions to the tender scope have necessitated more time for considerations, which has delayed tender publication and made the aforementioned modification necessary. Furthermore, while the tender is in progress, the modification is necessary to guarantee the ongoing provision of essential comprehensive clinical microbiology services that include the diagnosis, treatment, management, and prevention of infectious diseases.

The High Court is the arbiter of formal procurement challenges and the review procedures are as set out in the Public Contracts Regulations 2015. Proceedings under the Public Contracts Regulations 2015 are time limited, and any such proceedings must be brought in the High Court.
