Legal Justification

For the avoidance of doubt, the provision of the Public Contracts Regulations 2015 do not apply to this Modification and comes under the Provider Selection Regime, the services are for Rehabilitation, CPV Code, 85312500-4. This is a permitted modification under PSR Reg 13 (1) (a) as provision was made in the original tender documents to add additional funding to increase capacity and improve outcomes across the treatment and recovery service. The funding is from the Supplemental Substance Misuse Treatment and Recovery Grant (SSMTRG). This grant will be most effective in continuing to increase capacity being delivered within the existing service and will be used across the system for additional staffing. The modification does not alter the overall nature of the current contract.

This is a Provider Selection Regime (PSR) contract modification notice, under the Health Care Services (Provider Selection Regime) Regulation 2023. For the avoidance of doubt, the provision of the Public Contracts Regulations 2015 do not apply to this award. This contract is now been formally modified. General Manager's Jess Wilson, Ellen Langton, Vicky Smyth, Darran West, Christine Flinton, Rosalie Weetman, Shirley Devine.
