Legal Justification
This is a Provider Selection Regime (PSR) contract modification notice, under the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award. This contract has now been formally modified.' The modification changed the end date of the contract to 30/09/2024 The decision was approved by NHS Devon ICB Head of Contracting, referenced at the ICB PSR Steering Group. Conflicts of Interest have been sought by relevant decision makers and none were noted.

Award of a contract without prior publication of a call for competition in the cases listed below The services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons Explanation: The award decision has been determined as Step One Charity as the only provider identified that is capable of supplying the services required for the commissioner within the imposed timeframe. Agreement has been reached with Step One Charity and this negotiated procedure without prior publication has been followed and justified under regulation 32(2)(b)(ii) 'competition is absent for technical reasons' has been applied where no reasonable alternative or substitute exists.
