Legal Justification
Market research identified BCC AB as the only supplier capable of delivering all machinery, equipment and aftersales training services required by Newton Nursery in a single contract. Additionally, Forestry England have recently conducted an open tender activity for extremely similar equipment, and have provided confirmation that they only received one viable bid, which was from BCC. The mini plug seed trays that are part of the suite of machinery were specifically designed by Forest Enterprise England for their cell growing needs and these are not available elsewhere. Additional requirements: The entire machinery contract must be purchased from the same supplier as multiple suppliers risk purchases having different technical characteristics, resulting in unacceptable risk of incompatibility or disproportionate technical difficulties in operation and maintenance.
