Babcock Land Defence Limited, Acting as agent for the UK Ministry of Defence (MOD) proposes to negotiate a single source contract with Supacat Limited for the Repair of Jackal Assemblies and Associated Items for a period of 5 years, with the option of a further 2 years. The estimated total contract value is not to exceed £1,526,000. Please note, this notice is not a request for expressions of interest so please do not apply to be invited to tender. This notice advises that the Authority has decided to negotiate a contract with the named supplier on a single source basis, and is published for reasons of transparency. If you are interested in becoming a sub-contractor for this requirement, you should apply directly to the supplier named above.

Legal Justification
The Ministry of Defence (the Authority), intends to award a contract to Supacat Limited for the provision of The Repair of Various Jackal Assemblies and Associated Items for a period of 5 years with the option of a further 2 years. The estimated total contract value is not to exceed £1,526,000. In accordance with regulation 4 of the Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (as required by the relevant legislation) is lawful in accordance with Regulation 16(1)(a)(ii) of the DSPCR 2011 for technical reasons. Supacat Limited are the proprietary owners of the technical documentation for these assemblies and such work cannot be undertaken without access to the proprietary design information. Without the detailed technical information for the various assemblies a supplier would not be able to ensure repaired and reconditioned assemblies were fit for purpose in accordance with the original design specifications, or maintain configuration control such as build standards, drawing and test specifications. The assemblies to be repaired under this contract are considered to be of a safety critical nature.
