Legal Justification
DE&S Deca, on behalf of the Operational Infrastructure Delivery Team and part of the UK Ministry of Defence intends to enter into a contract with Link Microtek for the procurement for ten (10) additional EHP200A (Electric & Magnetic Field Analyser) for immediate supply to Users and to provide a stock holding. The contract value is below the PCR 2015 threshold and has a duration of 1 year. MOD currently has a fleet of Five MOD-EHP200 out in operation. The rest of the fleet have been decommissioned due to failure. The NSN (Nato Stock Number) satisfies the field analysing task, they require additional quantity to meet MoD analysing requirements. It is considered that this contract can be placed using the below UK Public Contract Regulations 2015 threshold Single Source Procurement without prior publication of a contract notice due to technical reasons. There is now a shortage MOD-EHP200 analysers due to failures. The current in service equipment uses handheld displays and software which does not require replacement, therefore having specific interoperability requirements. The EHP200 monitor can be operated through the accessory 8053-Display Unit, These displays are currently in service with OEM support and are only compatible with EHP200. MCTA (Maritime Commissioning and Testing Authority) are responsible for conducting EMF (Electric & Magnetic Field) measurements as mandated by UK statute law in SI 2016 No 588 and not having the EHP200 test equipment could leave the MOD open to legislative action. Link Microtek have an Exclusive distribution agreement from Narda to be sole distributor for the EHP200A to the UK market, limiting competition within the UK and Ireland.
