Legal Justification
The purpose of this VEAT notice is to inform and provide prior notice to the market that the Authority intends to modify Framework Agreement FAE-20-011 for the supply and delivery of portable staging. Following publication of this VEAT notice, the Authority will observe a 10 day standstill which will conclude at midnight on Friday 2nd August 2024. This opportunity/framework agreement was originally advertised in a Contract Notice (2020/S 124-305197). A Contract Award Notice (2020/S 237-586886) was also subsequently published. The framework agreement is currently due to expire on 31st August 2024 with no remaining extension options but the requirement has arisen to modify the framework end date to be extended by 6 months until 28th February 2025 with the option to extend by a further 6 months until 31st August 2025 if required i.e. potential extension of 12 months in total. This requirement to extend the period of the framework agreement has arisen following early investigations and pre-market engagement which indicated that the requirements of the renewal exercise need to be extended to include stage lighting and sound equipment. Some elements of the upcoming procurement reforms, such as the ability to award open frameworks could be of benefit to this renewal process. In order to avail of the procurement reforms further extensive pre-market engagement and investigation is required and therefore a delay to the renewal process is inevitable. In addition, significant staff resources are being prioritised and re-deployed to support the Authority's preparations for the upcoming procurement reforms. This is the first modification to this Framework Agreement. The modification is proposed in accordance with Regulation 72 (1) (c) and meets all of the following conditions: (i) the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen; (i.e. staff re-deployment) (ii) the modification does not alter the overall nature of the contract; (iii) any increase in price does not exceed 50% of the value of the original contract or framework agreement.
