Legal Justification
The Defence Science and Technology Laboratory (DSTL), part of the Ministry of Defence (MoD), intends to award a contract to Level Peaks Associates Limited, for supply of a Remote Piloted Aircraft System (RPAS) manufactured by Boresight Pty Ltd (Boresight) to be used to support testing of the UK's Counter-Unmanned Aerial Systems (C-UAS) capability. The contract will include the supply of programming software, batteries, battery chargers and training. The contract will be for 3 months and have an estimated value of £203,172.07. In accordance with the provisions of The Public Procurement (Amendment etc.) (EU Exit) Regulations 2020 SI No. 2020/1319, this procurement falls to be regulated under the provisions of the Public Contracts Regulations 2015 (PCR 2015) as amended (in particular by SI 2020/1319). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (as required by the relevant legislation) is lawful in accordance with regulation 32(2)(b)(ii) of the Public Contracts Regulations 2015 for technical reasons. This is because Boresight has confirmed that Level Peaks is the exclusive UK distributer of its RPAS. This RPAS is the only system considered to satisfy MoD's technical requirements relating to programmability (to be able to detect, react to and evade C-UAS frequency jamming activity) and to currently conform to Civil Aviation Authority and Military Airworthiness Authority standards, such that it is able to meet MoD's timescales for capability testing, scheduled for Autumn of this year.
