Legal Justification
Modification to the current framework is necessary to ensuring ongoing service provision and to facilitate the procurement of additional requirements until the commencement of a new arrangement is in place. These requirements have become necessary and are permitted by Regulation 72(1)(c) of The Public Contacts Regulations 2015. Namely, the following conditions have been fulfilled: (i)the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen; The Education Authority set up CAT-23-001 Dynamic Purchasing System for Catering Equipment which went live in May 23 with the original intention of running further competitions from the DPS. Following a strategic review, EA has opted instead to put in place a Framework Agreement, covering Food Preparation Equipment, Food Transport and Food Holding Equipment, the tender for which CAT-24-001 ‘Equipment for food holding, preparation and transport’ closed on 15 August 2024. The extension of this arrangement for a period of two months will ensure service continuity for the Catering Service and will also help align the end dates of the above mentioned expiring contracts with the estimated start date of the new arrangement, currently estimated to be 1 November 2024. (ii)the modification does not alter the overall nature of the contract; The nature of the Framework Agreement is not being amended. (iii)any increase in price does not exceed 50% of the value of the original contract or framework agreement. The short extension does not include a modification of the Framework value. The 2 month extension to time is well within the 50% permissible compared to the original term of 39 months.
