This notice is to advise that Fife Council intends to contract with Robertson Construction Group to design and build 20 new homes

Fife Council is in the process of delivering new Affordable Housing for social rent throughout Fife and these new properties form part of that delivery programme. The proposal to award the contract for Phase 2B (20 Units) to Robertsons is as per a variation/modification of the original contact awarded to Robertsons for Phase 2a. (This site is of near proximity (across the road) from Phase 2A).

Legal Justification
Fife Council is in the process of delivering new Affordable Housing for social rent throughout Fife and these new properties form part of that delivery programme. The proposal to award the contract for Phase 2B (20 Units) to Robertsons is as per a variation/modification of the original contact awarded to Robertsons for Phase 2a. (This site is of near proximity (across the road) from Phase 2A). The Public Contracts (Scotland) Regulations 2015 apply to this requirement as it is above the OJEU threshold. Regulation 72 (Modification of Contracts during their term) 72.—(1) A contract and framework agreement may be modified without a new procurement procedure— (b)to provide for additional works, supplies or services by the original contractor that have become necessary and were not included in the initial procurement, where a change of contractor— (i)cannot be made for economic or technical reasons such as requirements of interchangeability or interoperability with existing equipment, services or installations procured under the initial procurement; and (ii)would cause significant inconvenience or substantial duplication of costs for the contracting authority,provided that any increase in price does not exceed 50% of the initial contract value;
