Legal Justification
This is a Provider Selection Regime (PSR) intention to award notice. The awarding of this contract is subject to the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award. The publication of this notice marks the start of the standstill period. Representations by providers must be made to the relevant authority by midnight 17.09.24. This contract has not yet formally been awarded; this notice serves as an intention to award under the PSR. Representations can be sent to iain.mackie@bolton.gov.uk prior to the deadline above. Declarations of Conflict Forms were completed by all individuals involved in the decisions about the provider selection. No conflicts of interest were declared. The award decision makers are members of the Public Health Commissioning team. The submission was assessed and the provider selected against the following key criteria : • Quality and innovation • Value • Integration, collaboration, and service sustainability • Improving access, reducing health inequalities, and facilitating choice • Social value The rationale for using this process is as follows: This provider can mobilise the service within a short timeframe as per the allocated funding. They are a local provider with an existing presence within the targeted communities. Using PSR 'most suitable provider' enables us to effectively mobilise the service in a quick and timely manner as the grant allocation must be used in line with the grant conditions and the years in which it is provided to the Council. There is a specific requirement under the terms of the grant funding to channel this funding through local stop smoking services and offers of support. The provider has demonstrated significant evidence that they meet the 5 key criteria. The evidence has been evaluated and the authority is confident that the provider can deliver the contract.

The lifetime of the project is for an initial period of 1 year. This is a new service and a new provider and it is anticipated that the service will be provided between 01.10.24 - 30.09.25. The lifetime value (1 year) of this contract is £6,000
