Legal Justification
ForHousing Limited is not required to publish a call for competition in the Find a Tender Service for the proposed call-off contract on the basis that this contract is being awarded pursuant to the Procurement For Housing framework. ForHousing Limited and Procurement For Housing are satisfied that the proposed call-off contract is being awarded in compliance with the framework agreement and in accordance with its terms. As such, the proposed call-off contract is permitted under the Public Contracts Regulations 2015 (the "PCR") and complies with the rules re. awarding contracts based on framework agreements as set out in regulation 33(8)(a) of the PCR. Prior publication of a Contract Notice is therefore not needed.
Other Information
Whilst Grounds Maintenance is not explicitly specified in the Framework, ForHousing considers the addition of the grounds maintenance service is permitted under Reg 72(8) PCR 2015 as this does not amount to a substantial modification. The grounds maintenance services amount to 5.6% of the value of the contract and ForHousing is satisfied that this is not a substantial modification to the overall scope.
