For the procurement of a MI System (adult education software) that supports ACL to manage the ESFA contract. ACL are the third largest provider in the country. They manage an £8 million government contract from the Education and Skills Funding Agency (ESFA) covering a wide range of curriculum provision including accredited learning, non-accredited learning, Apprenticeship, Skills Bootcamps, bespoke projects and employer led provision.

Legal Justification

A Waiver was approved to depart from Internal Rule 20 - General Principles Across Medium Risk Procurements: Where a contract total value exceeds £100,000 yet falls below the relevant European Thresholds a simplified tender process is required. This contract is for £152,150.40 which is below the PCR2015 threshold. There are no provisions within the existing contract to extend the agreement. This necessitates a direct award to ensure continuity of service without disruption - Terms is a business critical piece of software so we need to retain the system for the next 3 years as we expect the whole process including moving to a new solution to take 3 years.
