Description
In recent years primary-age pupil growth has declined, leading to a decreased demand for primary school places overall. This position has led to the Council reconsidering its options for new school delivery linked to new housing development, alongside other factors such as rising costs of delivery, sustainability and net zero ambitions, as well as supporting the viability of existing schools operating in the area. As a result of these considerations, and following discussion with the developers, an opportunity has been identified to rationalise delivery of new primary education provision, making best use of available assets and funding, whilst also providing sufficient capacity to meet identified needs. It also offers an opportunity to allow the Weldon Park Site to be developed for SEND purposes. This provides a valuable site for any potential Department for Education (DfE) New School Bid opportunities. The intention is to reallocate Section 106 funding from the Weldon Park development towards delivery of a new three form entry primary school at Priors Hall Zone 2.

Legal Justification
A land development arrangement does not falls within the definition of a works contract. However a VEAT Notice is being published to ensure transparency regarding a decision to reallocate S106 funding. The funding for this project is: a) S106 funds which is not public funds (i.e. public resources) in their origin. b) The S106 funds are only being paid to the Council to facilitate and accelerate delivery of additional education capacity necessary to meet the demand arising from the related development. c) The works being undertaken are by the Priors Hall developer; the S106 funds from Weldon Park will recompense the Priors Hall developer for early delivery of the additional capacity (3rd form of entry) and as such do not confer any economic advantage to them.
