Legal Justification
Single Source contract with UKCEH for the Data License due to the Supplier being the only provider of these key licenses. Although this requirement is below the PCR 2015 threshold for supplies and services (£139,688), the justification for single source under regulation 32 (2) (b) of the PCR 2015 for use of the negotiated procedure without prior publication is against reason ii) “competition is absent for technical reasons” – the justification for this is as follows:o Due to the specific level of detail provided by UKCEH against the Land Cover dataset, this license provides the requisite performance for the Customer to meet the required outputs and any deviation from this dataset would be detrimental to DEFRA’s mission.o The unique maps that only UKCEH can offer provide a dataset of application rates at a fine resolution and national scale. The fertiliser map estimates average fertiliser applications between 2010 and 2015 for the whole of England and the pesticide map looks at average pesticide applications between 2012 and 2017 in England, Wales and Scotland. The data for both is provided at a 1km resolution, showing the kg of the active ingredients per 1km2. This meets the requirements of DEFRA to meet its missions.o Due to the scope of the UKCEH Dataset and the unique detail it provides, DEFRA cannot use any other provider.
