Legal Justification
The Air Commodities Delivery Team (ACDT) within Defence Equipment & Support (DE&S), part of the UK Ministry of Defence, (“the Authority”) intends to place a Single Source Contract with Marlborough Communications Limited for the In Service Support for the Provision of Repair and Post Design Services (PDS) to Elmer Radio and AD120 Avionic Communication Equipment for an initial 3 year term with an Option to extend by a further 24 months in 12 month increments. The value for the contract is estimated at £4.7m over the maximum 5 years. Due to the Authority receiving only two PQQ responses with only one response meeting the minimum criteria the Authority has a failed competition and competitive procurement under the accelerated restricted procedure is no longer possible. Therefore a Single Source procurement in line with Regulation 16(1)(f) of the Defence and Security Public Contract Regulations (DSPCR) 2011 is the only feasible option to meet the requirement to provide continued support to the Elmer Radio and AD120 Avionic Comms equipment.
