Legal Justification
The Specialist Explosive Ordinance Disposal Search, Exploitation Countermeasures (SEEC) Project Team, part of the UK Ministry of Defence, intends to award a contract to Cobham Aerospace Connectivity for up to 7 years for in service support of HORN, which is a handheld metal detector. It is considered that this contract can be awarded to Cobham Aerospace Connectivity using the negotiated procedure without prior publication of a contract notice pursuant to (Regulations 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011), for technical reasons. This is because Cobham Aerospace Connectivity is the Original Equipment Manufacturer (OEM) of HORN and is the only supplier to have access to the required equipment for calibration, performance verification, diagnostics and fault code clearing for these devices. In addition, Cobham Aerospace Connectivity have specialist and in-depth knowledge of the functioning of the HORN fleet enabling more effective technical support and are the owners of detailed configuration management documents that would not be accessible to new contractors. Cobham Aerospace Connectivity, as the OEM, are the only company with specialist knowledge of HORN, any other company would have to reverse-engineer the detector to understand its make-up and perform extensive testing and trials in order to ensure that the risk to users from safety critical parts remains as low as is reasonably practicable. As such, Cobham Aerospace Connectivity are the only supplier able to carry out repairs and in-service support due to the tools and expertise required
