Legal Justification
The Lightning II Delivery Team, part of the UK Ministry of Defence (“MOD”), intends to place a 2 year contract with BAE Systems PLC to purchase two software licences for the BAE Systems PLC trilogiBuild software application, part of the trilogiView® suite of products produced by BAE Systems PLC, for use in connection with the trilogiView® toolset for generating, distributing, viewing and managing interactive electronic technical publications, which is mandated under the F-35 Program. The contract will have an estimated value of £76,100. It is considered that this contract can be placed using the Negotiated Procedure without prior publication of a Contract Notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 32(2)(b)(ii) of the UK Public Contracts Regulations 2015) for technical reasons. This is because UK technical publication DAP101B-8600-2(N/R)1 Support Authority General Orders & Special Instructions LII F-35 (all marks), which contains the relevant UK technical information and Military Aviation Authority Regulatory Articles (“RAs”) is incompatible with trilogiView® resulting in aircraft maintainers being unable to access all the required air system maintenance technical information on the portable maintenance aids at the point of use, as required by RA 1310 Air System Document Set, thus inhibiting the required maintenance of the aircraft and causing a risk to aircraft safety. The purchase of the trilogiBuild licences, which are only available from BAE Systems PLC, the owner of the IPR, will enable the conversion of the 2(N/R)1 file data into a trilogiView® compatible format that can be viewed correctly on the maintainer’s portable maintenance aids as required by RA-1310, thus enabling compliance with RA 1310. It would only be possible to provide 2(N/R)1 data at the point of use without trilogiView® compatibility by procuring additional hardware and additional software and subjecting all required interface changes to full technical and security re-validation and accreditation.
