Description
This is a Direct Award for the provision of Mortuary Service for HM Coroner, East Sussex. The resulting contract will ensure that Coroner’s bodies can be appropriately stored pending a decision as to whether a post-mortem examination is to be carried out and in suitable premises where a post-mortem examination can take place if required. These services are of a specialist nature and are required between 1 April 2021 and 31 March 2024. There is also an option to extend the contract for a further 2 years in 1 year increments.

Legal Justification
Under Regulation 32(2)(b)(ii), the negotiated procedure without prior publication can be used for public services contracts where the services can only be supplied by a particular economic operator because competition is absent for technical reasons, provided that no reasonable alternative or substitute exists and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement. There is an absence of competition for these services. Although there are other providers, those providers do not have sufficient capacity to store the volume of bodies that would be required of the Council’s prime contractor. In addition to this the transport costs of delivering bodies outside of the county boundary would take the contract outside of the Council’s financial envelope for these services. On this basis, it is considered that the conditions for using the negotiated procedure without competition are met, and that this would be the most appropriate procurement route for this contract.
Other Information
The overall value of the contract maybe more or less than GBP 1 250 000 as this is a needs based service. The figure of GBP 1 250 000 is based on 2020/21 activity and the new pricing, however based on the 2019/20 activity and the new pricing, the total value would be GBP 1 125 000.
