Legal Justification
Further to the separate Voluntary Ex Ante Transparency Notice ref. Works - 331318-2020 as published 14.7.2020, which is unrelated but is referenced to this contract. The Authority's reactive Repairs, Maintenance and Voids servicing contract, to be delivered within four separate Lots covering specific geographical areas within the borough of Runnymede, was originally awarded to 2 suppliers in January 2019 on the basis of a 3 year term. The original supplier of the services in respect of Lots 1 and 2, has surrendered their contractual obligations to the Authority in respect of the contracted services, prior to the expiry of the original term. The scope of works pertaining to the Authority's reactive Repairs, Maintenance and Voids works contract, is wholly referenced to the Authority's duties as a landlord in connection with the routine, day to day maintenance and upkeep of its tenants and leaseholders' dwellings to ensure they are in a safe and habitable condition. The Authority now intends to enter into formal contracting arrangements, and create a formal contractual obligation in respect of Lot 1 and Lot 2, between the Authority and the incumbent supplier of the services in respect of Lots 3 and 4. The Authority considers that, under the circumstances entering into a new contract without a formal tender process, in respect of Lot 1 and Lot 2 with the incumbent supplier of the services for Lot 3 and Lot 4 is permissible as provided for in Regulation 32, on basis that the Authority, were it not to enter into the contract with the incumbent supplier of Lots 3 and 4 to provide a continuity of service to tenants and leaseholders in the relevant geographical areas covered by Lot 1 and Lot 2 under the provisions of this Regulation, would find itself to be in breach of its statutory obligations.
