Legal Justification
Thales is the only economic operator capable of undertaking the required modification to the Transmission Based Train Control (TBTC) system. (a) Thales, who were the original design and installation contractor for the TBTC system and have provided technical support services for the system since its installation, possess in-depth knowledge of the operation and function of the system; (b) Thales are the Design Authority for the TBTC system and any modifications to the system will affect the Safety integrity Level and will therefore need to be assured by Thales to maintain the current safety case; (c) Thales have built up unique knowledge and experience of the system which enables them to quickly diagnose and fix any issues without causing operational issues; (d) No other economic operator would have, or would be able to acquire the expertise or knowledge to provide the required modifications to the TBTC System.
