Description
HSE entered into a contract with Sheffield Teaching Hospital for the period 1/11/2021 through to 31/10/2022. HSE are now looking to invoke a pre existing extension provision for a further year until 31/10/2023.

HSE is looking to extend the services of medical advisers who apply medical, health and scientific knowledge to assist HSE to prevent work related ill health and ensure health related research projects can be delivered safely.

Renewal Options
The Services shall commence on 1st November 2021 and shall be completed by 31st October 2022, with an option to extend by up to a further 24 months, subject to the written agreement of both parties in line with the Variation to Contract Clause at item 15.

Legal Justification
Award of a contract without prior publication of a call for competition in the Official Journal of the EuropeanUnion in the cases listed below • The procurement falls outside the scope of application of the directive Explanation: Regulation 32 exempt: 32(2)(b)(ii) whereby competition is absent for technical reasons. HSE asserts its beliefthat Sheffield Teaching Hospital is the only economic operator in the EU that is capable of supporting HSE inrespect of delivering the service required. The work delivered by physicians to HSE requires a unique combination of both medical expertise (up to dateand relevant to real clinical situations through continued medical practice and diagnosis) coupled with a deepunderstanding of the regulatory and policy aims of the HSE. The roles do not lend themselves to a 'pool of different medics' doing the work on a 'who is available' basisas the Medical Advisers actively contribute and are instrumental to the wider occupational health work ofHSE. They play a key role in governance and delivering the 'clinical lead' function, including taking the leadon regulatory aspects of medical and health work, scientific and research activity or revalidation and appraisalaspects of HSE's medical activity. This integrated approach of maintaining hands-on clinical knowledge coupledto regulatory knowledge is vital for HSE to deliver its role and act as the government's chief occupational healthadviser.
