Legal Justification
The current Contract 70242 Female Hygiene, Clinical and Nappy Waste Units for the EANI commenced on the 9 March 2017 with a total contract value of £200,000. The impact of the global COVID-19 pandemic has resulted in an unprecedented uptake in demand on this contract which could not have been foreseen by EANI. Modifications were undertaken in May 2021 and June 2021 to increase the value of the Contract in total to £393,000 until 31 January 2022. A further modification will now take place to increase value by £25,000 and to extend the contract by a further period of three months. This is less than 25 percent of the original contract value and will extend the contract until 30 April 2022. EA have commenced a procurement exercise for a new contract for these services and award decision is envisaged in January 2022. This short extension to the contract is to allow evaluation process to be completed. The modification of the current contract is required as the initial pre-tender stages of the re-procurement were delayed due to unforeseen circumstances that a diligent authority could not have foreseen as staff were diverted to other recent priority projects that came about due to the COVID-19 pandemic. The modification to this Contract is in accordance with Regulation 72(c) of the PCR2-15 in that: (i)the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen; (ii)the modification does not alter the overall nature of the contract; (iii)any increase in price does not exceed 50% of the value of the original contract or framework agreement. The contract modification will not be entered into until 7 January 2022.

Following the withdrawal of the awarded Supplier on 31/07/2018, the contract was awarded to the second ranked tenderer in accordance. with the Terms and Conditions of the contract (i.e. Personal Hygiene Services Ltd).
