Total Quantity or Scope
Direct Award using KCS Software Products & Associated Services Framework agreement (Y20011) for Microsoft software and services.Regulation 33(8)(a) of the Public Contracts Regulations 2015 (PCR 2015) sets out the criteria formaking a 'Direct Award' where a Framework Agreement is concluded with more than one supplier.In accordance with the above regulation, a 'Direct Award' orders may be placed under this FrameworkAgreement provided the Contracting Authority can meet any one of the following objective conditions:• The Contracting Authority is satisfied that, following their own due diligence, they can identify the supplier that offers best value for their requirement• The supplier is able to supply the required goods/services within the Contracting Authority's timescales• The supplier scored the highest mark for price/quality in the framework agreement evaluation• Goods/services required are unique/exclusive to one vendor/supplier• Continuity of existing goods/services from an awarded supplier

Legal Justification
This requirement was procured using the Kent County Council t/a KCS Software Products & Associated Services 2 - Y20011 Framework Agreement via a 'Direct Award'. The KCS Framework Agreement Contract Notice to establish the Framework Agreement was published in OJEU ref: 2019/S 209-509650, and Contract Award Notice ref: 2020/S 114-277951.Therefore, under the Public Contracts Regulations 2015, VisitBritain was not required to submit a call for competition by publishing an FTS Contract Notice.
