Description
Road-maintenance works. Within each Contract, the works may include but not be limited to the following principal work activities provided by way of example: A. Permanent reinstatement of openings and repairs to defects in foot-ways and carriageways with all types of surfaces (bituminous materials, concrete, brick pavers, flags, kerbs etc.) B. Adjustment/provision drainage installation and maintenance schemes C. Earthworks D.Environmental Works E. Provision and maintenance of fences and pedestrian guardrail. F. Reconstruction of carriageways and foot-ways G. Accommodation works including walls, fencing etc. H. Adjustment/ provision of kerb lines I. Small network improvement schemes e.g. Traffic Management Schemes, Traffic Calming Schemes J. Other associated ancillary work.

Legal Justification
Delays to the Department’s construction procurement programme for works and maintenance, following the Covid pandemic and legal challenges to other related procurements. The delays have been exacerbated by the need to have a staged release of Term Contracts of similar works scope.Expenditure has increased through these contracts due to high inflation costs and the Department's reduced ability to deliver its work programme through its internal contractor partly due to recruitment difficulties and strike action.These modifications are considered to deliver value for money and are in the public interest. It is considered a reasonable and proportionate step in order to maintain these essential services whilst balancing against our legal duty to expose the service requirement to full, open competition, tenders for which are currently being evaluated.
