Legal Justification
Regulation 32(2)( c) of the Public Contract Regulations 2015 allows direct award:- 'insofar as is strictly necessary where, for reasons of extreme urgency brought about by events unforeseeable by the contracting authority, the time limits for the open or restricted procedures or competitive procedures with negotiation cannot be complied with.' The Council assumed direct operation of the EFW after the unexpected collapse of negotiations with the operator in late January. The 'outage period' is set by reference to what is necessary to comply with the plants permit from the Environment Agency issued under Environmental Protection Act and subsidiary regulations. The equipment and services required during the outage are of a specialist nature with a limited number of potential suppliers at any time. The lead in times for such equipment and specialist contractors are considerable and planning for the outage and engaging the market commenced in mid 2022, prior to the Council having responsibility for the plant. The interim operator, as professional advisors and operators have advised that:- • unless orders are placed urgently with each of the suppliers listed the necessary works cannot be undertaken in the scheduled outage period and • the plant would have to cease operation until the works are rescheduled, probably not until mid 2024 and the conditions of the Environmental Permit would not be complied with. Therefore the award of the attached contracts satisfied the legal requirements of PCR32(2)(c ) .
