Description

Leidos Supply Ltd intends to award a single source framework for a duration of 3 years to support the existing fleet of Tempus Pro Patient Monitors in service across the MOD, via the provision of spare parts, accessories, software, training, servicing and support for these devices. The requirement also includes the procurement of additional Tempus Pro devices to expand the current fleet, as well as replacement devices for units considered Beyond Economic Repair (BER). It is considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 32 of Directive 2014/24/EC of the European Parliament (Regulation 32(2)(b)(ii) of PCR 2015). The manufacturer (Philips RDT) are the sole supplier to the UK military market for Tempus Pro patient monitors, as well as associated spares, accessories, software, training, servicing and support.

Negotiated procedure without prior publication The works, supplies or services can be provided only by a particular economic operator for the following reason: - The protection of exclusive rights, including intellectual property rights. - for additional deliveries by the original supplier which are intended either as a partial replacement of supplies or installations or as the extension of existing supplies or installations where a change of supplier would oblige the contracting authority to acquire supplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation or maintenance (Regulation 32(5)(b) of PCR 2015). Leidos Supply Ltd intends to award a single source framework to support the existing fleet of Tempus Pro Patient Monitors in service across the MOD, via the provision of spare parts, accessories, software, training, servicing and support for these devices. The requirement also includes the procurement of additional Tempus Pro devices to expand the current fleet, as well as replacement devices for units considered Beyond Economic Repair (BER). The manufacturer (Philips RDT) are the sole supplier to the UK military market for Tempus Pro Patient Monitors, as well as associated spares, accessories, software, training, servicing and support. Failing to use products that have been approved for use with the Tempus Pro Patient Monitors or that are software compatible would potentially result in device safety issues and non-conformance of warranty resulting in a voided warranty.
