Description
UK Partnering for Accelerated Climate Transitions (UK PACT) is part of the UK’s Official Development Assistance (ODA) budget and responds to the critical global need for technical assistance to help developing countries implement their commitments under the Paris Agreement, recommendations from the UK’s Independent Commission for Aid Impact (ICAI)’s 2014 review of the International Climate Fund (ICF), and the Government’s vision for the UK’s global clean growth leadership to inspire others and support increased prosperity for the UK. The ultimate goal of the programme is to reduce poverty by maximising emissions reductions in developing countries in order to promote clean growth and avoid dangerous climate change. UK PACT strengthens relations with partner governments, builds capacity in key partner institutions, and raises the visibility of the UK’s work in this field. To deliver on these goals, the UK PACT programme is split across three components, for each of which a Delivery Partner was procured under a separate Lot. The UK PACT programme (and associated contracts) transferred from the Department for Business, Energy and Industrial Strategy (BEIS) to the Foreign, Commonwealth & Development Office (FCDO) on 1st April 2022. This Contract is Lot 2: Green Recovery Challenge Fund and is one of three Lots. Lot 1: Bilateral Country Programming and External Communications was awarded to Palladium International Limited and Lot 3: skill-shares and secondments was awarded to PA Consulting Services Limited

Legal Justification
This contract amendment is permitted under Regulation 72 PCR, under limbs; Reg 72(1)(a) - the modification is in line with the initial procurement documents which envisioned an extension up to c. January 2025. Reg 72(1)(b) - a change of contractor cannot be made for economic (procurement costs) or technical (programme activity continuity) reasons, and would cause significant inconvenience (programme activity continuity) or substantial duplication of costs (procurement costs) for the contracting authority. Reg 72(1)(e) – this modification is not substantial, on the grounds that: Reg 72(8)(a) - the modification does not render the contract materially different in character. Reg 72(8)(d) - the modification does extend the scope considerably. Reg 72(8)(b) – FCDO does not consider this amendment would have allowed for the admission of additional candidates, allowed for the acceptance of another tender, or attracted additional participants. This contract modification will enable the re-procurement of the UK PACT programme to be completed without disruption to the operations of the Authority and mitigates the risks the Authority would face because of any such disruptions. This is considered by the Authority to be a necessary step as a new procurement could not be completed in a satisfactory manner before the expiry of the current contract without extension and alternatives would entail significant inconvenience and potential increase in costs for the Authority.
Other Information
As a result of delays in the procurement process of the successor contract, the Authority's requirements demand continued access to these services beyond the current end date of the contract. The Authority is unable to change contractor at this stage for economic and technical reasons, and to do so would cause significant inconvenience and substantial duplication of costs for the Authority. Recognising the need for a long-term solution, the Authority has already undertook the re-procurement activities and are in the final process of governance approval for the next phase of the UK PACT programme to provide a sustainable basis for meeting these requirements. In the short term however, the Authority considers it necessary to exercise a contract amendment to Lot 2: Green Recovery Challenge Fund, delivered by ICF Consulting Services Limited. This procedure will; i) extend the term of Lot 2: Green Recovery Challenge Fund from 31/12/2023 to 31/03/2024; and Ii) increase the upper value limit of Lot 2: Green Recovery Challenge Fund from £5,204,457 to up to £5,465,404
