Legal Justification
The decision to issue this VEAT Notice arises from the Contracting Authority's observation of a consistent lack of competition in previous tender exercises for landscape maintenance services. Despite efforts to attract multiple bids, the number of participating suppliers has been limited, leading to concerns regarding the competitiveness and cost-effectiveness of the tender process. Furthermore, historical data from previous tender exercises has revealed that the tender returns received were disproportionately expensive compared to the estimated value of the services and to that of the incumbent Local Authority submission. Such expensive tender returns have not only strained the budget allocated for landscape maintenance but also raised questions about the efficiency and sustainability of the procurement process. This decision is made in accordance with Regulation 13.8 of the Public Contracts (Scotland) Regulations 2015 (Public Contracts between entities within the Public Sector) which allows for the award of contracts without prior publication between entities within the public sector where 1.the contract is for the purpose of establishing or implementing co-operation between the contracting authorities with the aim of ensuring that public services they have to perform are provided with a view to achieving objectives they have in common; 2.the implementation of that co-operation is governed solely by considerations relating to the public interest; and 3.the contracting authorities perform on the open market less than 20% of the activities concerned by the co-operation. unforeseen events or circumstances necessitate immediate action and where the time limits for the open, restricted, or competitive dialogue procedures cannot be complied with for reasons that are not attributable to the contracting authority.
