Description
Lisburn and Castlereagh City Council has a number of properties and built environment assets which, require both planned and unplanned maintenance. While individual maintenance requirements can be unpredictable, the amount of money available to be spent maintaining the Councils’ built environment assets tends not to vary dramatically from year to year. The various Council functions are divided into a number of departments. The maintenance of most property and built environment assets comes under the aegis of either the Council’s Assets: Estates, Building Maintenance or Construction Services. This Tender opportunity aims to enable a list of appropriately competent Mechanical Contractors to be appointed to carry out a range of maintenance and new installations under contract

Legal Justification
This relates to the variation of an existing contract which was procured under the PCR2015, where top 3 contractors were awarded a place on the contract. Proposed cost increases to the existing contract are attributable to fluctuation in RPI and the on-going increasing costs associated with fuel, energy, materials and staffing costs. The contract allows for a further three periods of 12 months each, acceptance of same is at the sole discretion of the Council. The council are content that it is reasonable to assume that contractors would not have foreseen the current cost increases in delivering services under the contract at time of tendering. This variation is permitted by Regulation 72(1)(c) of the Public Contracts Regulations 2015 (c) where all of the following conditions are fulfilled:— (i) the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen; (ii) the modification does not alter the overall nature of the contract; (iii) any increase in price does not exceed 50% of the value of the original contract or framework agreement
