Legal Justification
The UK Ministry of Defence, (“the Authority”), intends to renew its Enterprise Agreement with Oracle Corporation UK LTD (“Oracle”) for up to 60 months. This is a renewal of the Oracle Enterprise Agreement which ran from May 2021 to May 2024. This renewal is justified under Regulation 32(2)(b)(ii) of the of the Public Contracts Regulations 2015 where competition is absent for technical reasons and where the works, supplies or services can be supplied only by a particular economic operator. Oracle provide on premise solutions used by the Authority for the core ERP solution for Finance and procurement systems, as well as an Oracle Cloud SaaS for the provision of Core Civilian HR, Talent & Performance, Absence, Digital Assistant, Learning, Project and HR Helpdesk, known collectively as MyHR. In order to provide access to these services the Authority requires software licences and support. Oracle, as the provider of the core services, is the only entity able to grant these for technical reasons and/or for reasons connected with the protection of exclusive rights.
Other Information
The Authority reserves the right to amend any condition related to security of information to reflect any changes in national law or government policy. If any contract documents are accompanied by instructions on safeguarding classified information (e.g. a Security Aspects Letter), the Authority reserves the right to amend the terms of these instructions to reflect any changes in national law or government policy, whether in respect of the applicable protective marking scheme, specific protective markings given, the aspects to which any protective marking applies, or otherwise.
