Legal Justification
Salvage and Marine Operations (SALMO), part of the United Kingdom Ministry of Defence, intends to award a contract (711300452) to Forum Energy Technology (UK) Ltd (‘FET’) for the provision of a Remotely Operated Vehicle (ROV), Spares and In Service Support. The contract has an estimated value of £18M and a duration of 2 years and 9 months. It is considered that the award of this contract without prior publication of a contract notice in the UK e-notification service (as required by the relevant legislation) is lawful in accordance with Regulation 7(1)(a) of the Defence and Security Public Contract Regulation (DSPCR) 2011 for national security reasons. SALMO have determined that currently only FET can supply the ROV that fully meets all the Key User Requirements (KUR’s) which are: Depth rating and ability to upgrade to threshold; Payload Capacity; Operating System and INS – ability to dynamically position; UK Original Equipment Manufacturer (OEM).
