Description
Suffolk County Council have negotiated exclusive access to a 2-bedroom bungalow that had previously been unavailable to disabled children and young people within our remit in order to meet sufficiency for two disabled children with significant medical health needs. The property has been modified in such a way that it is able to accommodate children with complex medical needs, including those who are wheelchair users. The council now has a requirement to place two young people in this home, due to the specialist equipment and skills/expertise needed to meet their medical requirements and the need to place them together as siblings. Our research has concluded that there are no other suitable providers in the local area that can fully meet the needs of these two young people. Therefore, the council intends to award a contract directly to Achieving Aspirations Community Interest Company (CIC) for this service.

Legal Justification
The Council is content that PCR 2015 Regulation 32(2)(b)(ii) can be complied with in awarding a contract to Achieving Aspirations CIC because: Works, supplies or services can be supplied only by a particular economic operator (i.e., competition is absent for technical reasons). Suffolk County Council has determined that competition is absent due to the lack of suitable providers in the region who can cater for the complex medical needs of siblings to be accommodated together with the highly specialist nature of the services required. As such, the council intend to commence negotiations with Achieving Aspirations CIC to enter into a new agreement, on largely the same terms used in previous contracts for similar services. Our intention is to finalise these negotiations by Friday 18th October 2024. Achieving Aspirations CIC has been supporting the council to care for Disabled Children and Young People through a series of contracts for over 10 years, and they currently operate a Short Breaks and Shared Care service in the county. This gives them a good understanding of the young people we want them to care for through this contract, and gives us confidence in their ability to support them. Whilst the Council is confident that its analysis of these circumstances is correct, it remains committed to meeting its public procurement obligations and, in particular, commitments to transparency and equal treatment. Suffolk County Council reserves the right to procure repeat requirements of a similar nature without a further call for competition pursuant to Regulation 32 of the public contracts Regulations 2015.
