Description
Wolverhampton City Council has appointed a single provider to carry out the Repair and Corrective Maintenance of the equipment situated in these Play areas and Outdoor Fitness Areas. The scope of works will extend minor and structural repairs, refurbishment of equipment, and in some cases replacement of pieces of equipment that are beyond the point of economical repair. The number of Play Area sites may vary throughout the contract period. All works will be ordered in line with identified wear and tear as part of the councils play area inspection regime. The initial term of the contract will be for 3 years with the option to extend for two periods of 12 months with a total estimated value of £640,000.

Legal Justification
Regulation 32(2)(a) states that the negotiated procedure without prior publication may be used for public works contracts, public supply contracts and public service contracts in any of the following cases:— (a)where no tenders, no suitable tenders, no requests to participate or no suitable requests to participate have been submitted in response to an open procedure or a restricted procedure, provided that the initial conditions of the contract are not substantially altered and that a report is sent to the Commission where it so requests; This contract has been tendered twice, and submissions were received from the same suppliers each time. Unfortunately the tender submissions received did not comply with the award criteria set out in the procurement documents, and were therefore non-compliant.
