1 | Adult — CPAP, BiPAP, NIV and Sleep Therapy Devices and Associated Products for Acute Care and Primary Care Settings HTE are seeking to establish a new framework agreement for the provision of CPAP, BiPAP, NIV, Sleep Therapy Devices and Associated Consumables for Adults. The scope will include positive airway pressure Treatment devices which pump air into the lungs to prevent episodes of collapsed airways which obstructs Breathing with people with sleep apnoea or other Respiratory, cardiopulmonary or neuromuscular disorders, that are used in either a Public or Private Healthcare Environment, Private Enterprises, or within the Patient Home Environment. This will include (but is not limited to) to the following items: * CPAP, BiPAP, NIV and Sleep Therapy Devices for use at the patients home, public/private healthcare Environments or in private enterprises; and * CPAP, BiPAP, NIV and Sleep Therapy Devices suitable for travel. Associated Consumables will include such items as: • face masks, • CPAP/NIV hoods, • humidifiers, • headgear, • carrying case, • breathing circuits/systems, • filters, • sleep study systems, etc. • associated consumables shall include all products that would complement towards the care of the Patient whilst using the device. TERMS AND CONDITIONS / ACTIVITY BASED INCOME (ABI) The terms and conditions of this framework Agreement and any resulting call-off contract is appended to the ITT. These terms include provisions Requiring the payment by the supplier of an ABI management charge in consideration of the award of this Framework agreement, the management and administration by HTE of the overall contract structure and Associated documentation, as well as the requirement to submit regular management information to HTE. SUBMISSION OF EXPRESSIONS OF INTEREST AND PROCUREMENT INFORMATION This exercise will be Conducted on the HTE Bravo portal. The scope will include positive airway pressure treatment Devices which pump air into the lungs to prevent episodes of collapsed airways which obstructs Breathing with people with sleep apnoea or other Respiratory, cardiopulmonary or neuromuscular disorders, that are used in either a Public or Private Healthcare Environment, Private Enterprises, or within the Patient Home Environment. This will include (but is not limited to) to the following items: This Lot is for the supply of CPAP, BiPAP, NIV Associated Consumables only, which are used for those Patients having treatment for sleep apnoea, lung disease and similar illnesses, who require treatment For respiratory weaknesses. This Lot will include such products as: • face masks, * Nasal masks • CPAP/NIV hoods, • headgear,, • CPAP and NIV breathing circuits/systems, • Oxygen tubing * Breathing filters, and • Other associated CPAP/NIV accessories. All of which must be suitable for use for either Adults, Infants And Neonates in an Acute and Primary Care setting. 5 | Sleep and Respiratory Support Service HTE are seeking to establish a new framework agreement for the provision of CPAP, BiPAP, NIV, Sleep Therapy Devices and Associated Consumables. The scope will include positive airway pressure treatment Devices which pump air into the lungs to prevent episodes of collapsed airways which obstructs breathing With people with sleep apnoea or other respiratory, cardiopulmonary or neuromuscular disorders, that are Used in either a Public or Private Healthcare Environment, Private Enterprises, or within the Patient Home Environment. The requirements outlined for this Lot will include those as specified for Lots 1, 2, 3 and 4. However, the following are in addition to those requirements stated in the preceding Lots and is specific for Lot 5: The sleep and respiratory support service will incorporate a suite of incremental modules (1 to 5) for The provision of services as required by Participating Authorities. Participating Authorities may procure each Module individually or as a combination of modules bundled together. All goods and services provided will Support the diagnosis and ongoing treatment of the patient throughout their therapy care pathway from the Participating Authority’s premises to the patients’ home or care environment. The modules for this Lot are Broken down as follows: • Module (i) Patient Sleep Study The use of diagnostic systems which will help Determine the extent of the patients’ condition.• Module (ii) Patient Setup Once the patients’ treatment is Prescribed, this module focuses on ensuring the right device and associated consumables are provided. Legal Justification
(i) We propose to conclude a framework agreement (FA) with a number of providers all of whom Responded to the call for competition set out in the Contract Notice –2020/S 153 - 375968 and whose Tenders were compliant. Those bidders are identified in Section V. (ii) The range of services/supplies that are in scope remains unchanged. The number and contents of the Lots remains unchanged. The advertised award procedure was followed and the award criteria remain Unchanged. The only change is set out in clause (iii) below. (iii) This notice is to inform the market that we intend to increase the number of economic operators to be Appointed to Lots 1, 2, 3, and 4 of the FA. This will mean that for Lot 1 the number of appointees will be 11 rather than 6; for Lot 2 the number of appointees will be 7 rather than 6; for Lot 3 the number of Appointees will be 7 rather than 6; and for Lot 4 the number of appointees will be 12 rather than 6. The name and contact details (postal address) of each supplier to be appointed per lot can be found in Section V. (iv) The need for this modification has been brought about as a result of a marked increase in demand and Significant pressures being faced by suppliers and their supply chains as a consequence of the Covid 19 Pandemic. These are circumstances which the contracting authority, acting diligently, could not have Foreseen. The modification will increase the number of suppliers to whom customers can gain access, Thereby increasing competition and reducing the risk that demand for these products cannot be met Under the framework. (v) We consider that the change is permitted under Part 2 of the Public Contracts Regulations 2015 (as Amended) and Directive 2014/24/EC without the need for a new procurement. (vi) We have considered whether a new call for competition should be published. The modification does Not alter the overall nature of the framework agreement. The estimated total value of the FA remains Unchanged from that advertised. We therefore consider that the authority is entitled to rely on regulation 72 (1) (c) of the PCR 2015. (vii) We also consider that the change is not “substantial” within the meaning of regulation 72 (8) of the PCR 2015 (as amended) and Directive 2014/24, in particular, that it does not alter the scope of the FA; Does not make it materially different in character and would not have attracted additional participants Because of the nature of the market and the very high number of operators who expressed an interest and Submitted tenders. (viii) We will not conclude the FA for a period of 10 days beginning with the date after this notice is Published in OJEU.
Other Information
HTE is a central purchasing body who is able to carry out this tender exercise by virtue of its appointment As an agent of UHCW. Notwithstanding HTE’s relationship with UHCW, it is HTE conducting this tender Exercise and will execute the resultant framework agreement with successful bidders.
