Legal Justification
The procurement has been awarded utilising the negotiated procedure without prior publication utilising regulation 32(2)(b)(ii) ‘competition is absent for technical reasons¦. This is a compliant route to market under the Public Contract Regulations 2015 and Council’s Contract Procedure Rules. The contract will be awarded following a 10-day standstill period concluding on 29 March 2021. Due to an increase in the volume of cremations, the requirement to replace end of life equipment (which is uneconomical to repair) and the need to install a mercury abatement system, new cremation equipment is required. Due to the proprietary nature of the current equipment and systems already in-situ, technically it is not possible to integrate a competitor system. Correct system integration is critical in ensuring the environmental impact of the equipment is contained and meets required legislation for cremation and air quality standards.
