Indicators
- Contract modified due to unforeseen circumstances.
Legal Justification
The reasons for the modification are consistent with the grounds in Regulation 72(1)(c) of the Public Contracts Regulations 2015, as all of the following conditions are fulfilled:i. the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen. It had a greater requirement for services under the Framework than originally expected (the COVID-19 pandemic created a need to urgently procure additional services/supplies).ii. the modification does not alter the overall nature of the contract. The overall nature of the framework agreement is unaltered; the number of lots, economic operators and subject matter of call-off contracts are all the same as before.iii. increase in price does not exceed 50% of the value of the original contract or framework agreement (the overall value increases from £110m to £157.5m, Lot 1 increases from £95m to £142.5m, Lot 2 and 3 remain the same at £7.5m each)
